There is no ethical or legal reason to consider Hercules an illegal counterfeit, nor has IBM made such a claim. The legal issue is running licensed software without paying for an applicable license. Unless IBM gives you a license to run, e.g., z/OS, on Hercules then there is no legal way to do it.
