There has to be more to this story. Too much is not being reported. Who was the ultimate beneficiary of the code? What else was taken? Who else was involved? Is Sergey Aleynikov a US citizen? Was he convicted or did he take a plea bargain? Did he pass a background check? How was he caught? Etc. Etc. Etc.
