The seven judge bench Supreme Court Judgment on the issue of electoral
practices is a landmark of sorts. It says that soliciting votes in the name
of religion, caste and language should be regarded as a corrupt practice
under People’s Representation Act, leading to cancellation of the results
of the election. While it has restored the basic principle of Indian
Constitution and reaffirmed the secular nature of our Constitution, some
issues remain unresolved. The 1995 Justice Varma verdict known as ‘Hindutva
Judgment’ has not been visited, and this leaves lots of confusions. To say
that Hidnutva is a way of life, gives the votaries Hindutva Hinduism a
license to seek the votes in the name of Hinduism. The Hate speech which
precedes or accompanies the elections has been tormenting the social
fabric. The Hate speech is also meant to polarize the community and is an
exercise as a build up to elections. Narendra Modi declaring that he was
born a Hindu and he is a nationalist has been the most deceitful way of
soliciting votes in the name of religion. There are the likes of
Akbaruddudin Owaisi and ilk of Sadhvi Prachi and Sakhshi Mahraj who are
continuously on the job of spewing hate and preparing the ground for
elections. These unresolved points will weaken the impact of this judgment.
On the top of this the process following the complaint on the issue need to
be expedited, else by the time the judgment comes in these cases, the term
of the person concerned will be over, as courts do take years to settle the
matters. The political parties working for Islamic state or Hindu Rashtra
should have no place in the democratic set up.
