URGENT
Dear Colleagues ,
I am referring the serious situation arising following the
assassination of Advocate Shahid Azmi for immediate
action with Bar Associations and with the Chief Justice of
India and the Chief Justices and Judges of various High Courts .
The Indian Association of Lawyers may urgently discuss
and determine action to be taken in respect of this assassination which
has left scores of innocent citizens without defense, vitiating their trial .
The investigating agencies of the Mumbai Police have in the press
conference held that "patriotic" sections of the criminal underworld
decided to assassinate advocate Shahid Azmi as he was defending
citizens charged with terrorist related offences who were acquitted.
The fact is that 99% of those framed in cases filed over the last 10
years are innocent and some have also been killed in custodial
deaths with orders passed against the policie officials by the
Mumbai High Court .
You may probably be aware that Jt.Commissioner of Police Mr.
Hemant Karkare was similarly assassinated after his investigation
revealed that the serial bomb blasts in Mumbai , at Modasa in Gujarat
in Rajasthan and other places were committed by the fascist right
wing forces whose members are linked to organizations associated
with the assassination of Mahatma Gandhi .
Last year following a false report that some accused persons
arrested in ordinary criminal cases had plotted to kill lawyers
defending accused in so called terrorist related cases ,a Petition
was filed in the Mumbai High Court and the High Court passed
strictures on ascertaining that no such plot existed on the part
of those charged with minor offences and that misleading
press conferences were being conducted by some Police
Officials . That episode was a decoy for the developments
that are now taking place .
As you are aware none of the lawyers defending those who
assassinated Mrs. Indira Gandhi or Rajiv Gandhi were assassinated
similarly none of those who defended those who committed atrocities
against minorities in Gujarat , Maharashtra, Karnataka or against
Christians in Orissa have been assassinated .
To-day it may be citizens of poorer sections of the minorities
or lower middle income groups who are framed up and their
lawyers belonging to the same classes assassinated, to-morrow
without doubt this will extend to every body as criminalization and
violence is spreading across society . The bomb blasts are similar
to what happened in Northern Ireland , after the occupation of
Palestine , Iraq , Afghanistan and Pakistan .
There cannot be any Rule of Law , Justice or a civilized legal
system in a country where lawyers defending accused persons
are assassinated .The right to legal representation is the most
basic right in a democracy . Following the assassination news
reports have been planted by agencies that it is very difficult
to secure convictions , does this mean that the policing system
has been subverted in some cities and regions ????
Every border state of the Indian Union is populated
overwhelmingly by minorities who will determine their
attitude to the Indian State from the manner in which
minorities , Dalits , Other Backward Classes and honest
citizens of all groups and sections are treated in all
parts of the Indian Union .
The bomb blasts and assassinations appear prima facie
to perpetuate the divide and rule policy . However citizens
of every religious group are now questioning what is
happening , whether the most basic function of the State
that is protection to citizens has collapsed , even
as those killed in the bomb blasts are innocent citizens
with no connections .

Three acts of terrorism have taken place within a week indicating that
far from ambitions of being an emerging economic power , the Indian State is
being subverted from within , by bomb blasts , assassinations and criminal and
covert attacks on the police and para military organizations, with sinister
motives .
The brutal killing of 24 Jawans of the Eastern Frontier Rifles , the bomb
blasts in Pune and the murder of advocate Shahid Azmi who was appearing for
some of the accused charged with terrorist related offences ,raise several
questions which must be investigated by citizens and by those agencies which
are not already subverted as to the real organization , financial assistance
and inspiration behind these attacks .
Each one of these acts was a cover up operation . The manner in
which 24 Jawans of the Eastern Frontier Rifles were ambushed with the use of
motor cycles , Ambassador cars and other vehicles in Midnapore District appears
to be a well financed and organized operation even as severe infighting is on
between the Trinamool Congress and the CPM . The alleged message relayed by"
Kishanji " who claims to be a Maoist , who resembles in caricature the
internationally infamous and fictitious Osama Bin Laden ( in his grave now
for a almost a decade but still in use for propaganda ) that the attack was
in retaliation for Operation Green Hunt ( when the operation has been on now
for several months ) the nature of statements made by the people in the area
who surrounded the Finance Minister of Bengal among other ministers for
answers, raises several questions as the Maoists have never been a strong force
in West Bengal which has been wholly dominated by the CPM and since the
agitation against the Tata plant, by the Trinamool Congress which derived
maximum mileage from the protest even as the CPM is being marginalized . The
'Rizwanoor 'episode exposed the very core of the police administration of West
Bengal ,when a financier was allegedly able to influence officials of the
office of the Police Commissioner to use strong arm tactics against a member of
the minority community who had entered into an inter religious marriage which
is said to have resulted in the tragic death of Rizwanoor and one of the
Investigating officers investigating the death .
The Pune bomb blast in the German Bakery was first alleged by the media
to target the nearby Chabad House where Jewish visitors to India stay though
there is no anti-Semitism in India whatsoever . One such Chabad House also
figured in the 26/11 attacks when Mr. Hemant Karkare Jt. Commissioner of Police
and Mr. Ashok Kamte ( both outstanding and honest officers )among other police
officials and policemen were ambushed and killed at Cama hospital and scores of
innocent citizens lost their lives . Thereafter from one Headley to several
muslim organizations of Pakistan and India and several individual Muslims are
alleged to have committed the act .No one has clarified why the German Bakery
should be a target and what was the motive , as the German Bakery is neither a
financial , economic , political or geopolitical target ???????? The first
statement made on behalf of the government said that a gas cylinder had
exploded . If this is a bomb blast as certified as of now by Forensic
evidence being relayed on TV , it appears to be a cover up for the failure to
subdue citizens in respect of the episode related to the screening of the film
' My Name is Khan ' which is a film set in the United States and relates to
the discrimination minorities face with innumerable concessions to Bollywood
and political correctness without which the film would never have seen the
light of day .What is significant was the objection to people present in the
bakery from being interviewed by some agencies in Pune . The political
infighting within the Congress Party for the chair of the Chief Minister and
the strains in the alliance and the ties that both these parties have to the
SS and MNS and to members of the opposition compounds the difficulties of the
citizens .
The assassination of advocate Shahid Azmi himself a victim of the 92-93
riots and thereafter of the policing and legal system , having spent several
years in Tihar Jail before he was acquitted by the Supreme Court of all charges
, now killed merely because he was the lawyer defending innocent persons some
namely those alleged to have committed terrorist acts , including the Malegaon
blasts in which several innocent members of the minority community were
arrested , with access to evidence exposing the real nature of these blasts and
killings . This assassination of lawyers establishes without doubt that parts
of India are seeing the emergence of a ' state within a state ' , covert
agencies and groups taking over cities and regions , with the law enforcement
agencies helpless to expose these acts .
Retired police officials known for their integrity and their devotion
to their country and society are increasingly restive even as they see honest
officials and policemen gunned down by the covert mafia operating on behalf of
special interest groups , even as some organizations or individuals are made
the scapegoat for the attack . It is in the interest of the safety and security
of Police Officers and men including of para military and military
organizations that they must themselves probe what is happening and why they
are being ambushed in such large numbers and with what purpose .Investigating
the real reasons for any attack , is in conformity with conduct rules of any
service . Citizens should be as much interested in protecting the police and
other organizations responsible for their safety as much as for their own
security and safety .
Even as the Indian State weakened violence against minorities has become a
pattern for divide and rule . Following the assassination of Mrs Indira Gandhi
violence against minorities was unleashed by covert organizations using
political parties as a front . Thereafter when economic and financial policy
altered from 92/93 citizens are being killed either in pogroms and riots or in
bomb blasts . At first only citizens were victims in the main minority groups
and inviduals or those belonging to Dalits or weaker sections .This has now
been followed , by well organized and financed attacks on the police forces
and para military organizations , for which adequate explanations are not
forthcoming .Those members of the police force and Intelligence agencies which
are not subverted have a duty to the Republic , to their own forces and to
citizens to inquire into and expose covert forces , before criminality and
violence devours Indian society as a whole , even as the region we belong to
is increasingly vulnerable from predatory forces who desire to break us into
several pieces .

PS .We can only oppose internal migration from one region to another in
India which is one of the alleged reasons given for violence in Mumbai ,if we
are ready to call back every citizen or person of Indian origin who has
migrated abroad in search of a better life .Similarly if Pakistan is the reason
for the violence on innocent citizens of Mumbai and other areas ,then
logically it should have been followed by withdrawal of diplomats with
discontinuance of cultural, trade and sporting events , as declared
official policy, whereas policy is being made by violent vigilante
organizations . The media is taken over by every day hysteria on both sides ,
to distract people of both countries with both governments sorely in need of
diversions from economic and political policy , yet having the same
International Masters , the state of whose countries should be a useful lesson
for the subcontinent of South Asia as to which path to avoid .
