The issue of the Geneva Conventions on War Crimes conferrring universal
jurisdiction has to be raised as the ICC statute cannot violate Geneva
Conventions on the Laws of War .
The Yugoslavia , Rwanda among other Tribunals are all seriously flawed ,as is
the arrest warrant issued against the President of Sudan . Criminal
jurisprudence does not permit politically motivated trials or special trials
conferring special jurisdiction to single out some and frame others.
In Mumbai in particular and in other parts of India we are facing a serious
situation , lawyers who are engaged to defend those who have been charged with
being terrorists who happen to be from the minority communities are being
assassinated , removed as defense counsel or being physically attacked by hired
elements to prevent the truth of some of these being FRAME UPS emerging .
A young lawyer Shahid Azmi aged 32 has been assassinated in his LAW OFFICE
who was defending some of those held allegedly responsible from India for the
attack on Mumbai that is our 26/11 and for the earlier infamous Malegaon bomb
blasts where initially Muslim minorities were held responsible, until the Jt.
Commissioner of Police Mr. Hemant Karkare in a detailed investigation exposed
the Right Wing Fascist organizations and their leaders from some of the same
organizations responsible for the assassination of Mahatma Gandhi . Mr. Hemant
Karkare was also assassinated in an ambush where several police officers and
men were killed on 26/11.
Similar to operation Gladio in Europe, but in a different way covert agencies
are planting bombs in the vicinity of CHABAD Houses where Jewish visitors to
India stay . Since there is no anti-Semitism in India and we have a very small
Jewish community , these appear to be AGENT PROVOCATEUR ACTS .
However bomb blasts now go off at any time in India at any place and lawyers
are at grave risk from covert agencies being used for political purposes to
divide people by fascist covert bomb blasts .
As you are aware assassination of lawyers during a trial vitiates the whole
trial as it clearly establishes that evidence was obstructed from emerging
which would destroy the theory of the prosecution . How far can any of these
trials be said to be free from being seriously tainted . Even as innocent
members of the Muslim community are arrested and framed up for bomb blasts
planted by covert agencies .
Recently theatre houses were threatened with attack for showing the film " MY
NAME IS KHAN " under some specious plea as the theme of the film was
discrimination and the targetting of minorities .
Mahatma Gandhi believed that TRUTH ALWAYS PREVAILS .
We are living in uncertain times here with frequent bomb blasts .
The issue of attacks on Defense Counsel in India will have to be raised , as
there can be no Rule of Law in our society under such circumstances as lawyers
who defend those charged in politically charged allegedly terrorist cases which
could as well be committed by covert agencies are being assassinated .
