   Lastly one cannot be fiery as a Judge not even for the
  trial for War Crimes ......as the Judicial function requires
  dialogue at  a higher level , in an atmosphere free from
  fear or favour and a very , very, calm mind to enable the
  assisting lawyers to dialogue at their very best on the
  facts and the law .Every accused person should go 
  away with the feeling that the trial was very fair , very
  just and that he/she needs to redeem himself/herself
  to atone for what is unforgivable and psychopathic ,
  against norms set by human society for its own survival.

   Every human being who is being tried by a fair Judge
  should conclude after such a trial , that it was the wrong
  path , the wrong road  which led to such a trial . That is 
  what Mohandas Karamchand Gandhi would have expected
   of us even while trying the most anti-human forces let lose 
  on the world .I have to  remember that ......................

  The Resistance has its own tasks and its own duty .
  We  in the Tribunal have ours to unmask the truth even
  forthose who have committed war crimes , the truth of
  what they have done , to every man , woman and child,
  while perpetuating a system which instals destruction
  as the cornerstone of its policy .

  The cold war was over in Europe with the demolition
  of the Wall and then the hot war on the people of the
  world commenced with ferocity.

     Thank you for your sentiments .

    No, I would not have made an excellent Judge , as 
    I did not orient myself in that direction !!!!!!!! For 
    me to be a Judge, is a crown of thorns in one
    sense , but the work comes easily to me.The
    challenge is in an approach which is contemporary
    and reflects the judicial response to the human
    condition . 

    However , it is a strange kind of destiny that I have
    received so much regard and appreciation from legal
    and judicial circles and citizens in so many countries,
    including those who have held high political office ,
    that it has acted as a balm on the unjustified isolation
    that I faced in my own country for speaking the truth in
    very troubled times, which are not over .What is over
    is the deception , the camouflage  which even absolute
    censorship in unable to control .

     Before the Justice Srikrishna Commission I had
    the impossible task of proving killings by the
    police and fascist parties . That was the beginning
    of policy , the use of the  political and criminal
    underworld to divide and rule .The Judge was horrified,
    nothing in his legal experience had prepared him
    for this kind of evidence. Ultimately it is to his
    credit that he accepted the evidence, though two
    of us had to stage a walkout on the ground that
    justice was not only to be done ,but appear to
    be done . No one realized that I when I withdrew
    from the Commission it was because my work
    was over I had completed examining my witnesses
    and cross examining those who were vital .



    Without the complete support of one individual,
    the late Indrajit Gupta , the work would have been
    impossible .92/93 was the beginning of the  continuous
    pogroms and violence on citizens and minority groups , 
    the demonisation to divert attention from the diversion 
    of the National Exchequer and national economy to special
     interest groups. Earlier there was a pogrom on the Sikh
     community in 1984 to divert attention from the murder 
    of Mrs Indira Gandhi and the conspiracy which preceded it . 
    That was followed by bomb blasts  investigated by the late
    Jt.Commissioner of Police Mr.Hemant Karkare whom you
    may have met as he was the RAW representative in Austria
    for about four to five years , that did not prevent his being
    targetted for assassination .

    Without Mrs. Indira Gandhi' assassination , it was not
     possible to induct India back into the Empire . The
    second assassination secured India .Now most of
    our legislators are crorepatis just as the majorit in
    the US House of Representative and the US Senate.
    The best democracies !!!!!!! In UK you have seen
    the scandal on MPs allowances and the cash for
    appointments including to the House of Lords !!!!

    The kind of  Judicial segregation at KL was unnecessary
    and is not required even for normal judicial functioning,
    as the Conference in no way conflicted with the work
    of the Tribunal, however one has to respect the sentiments
    of the host country and their procedures .

    I was alarmed at the state of your leg as the boarding
    gate was a long way off and you could have taken
    some assistance .Medical Science has made great
     strides , so you should monitor yourself and arrest
     the situation with diet and medication as far as possible ,
    but avoid pain killers as they are dangerous in the long
    run . 

    I still do not understand how a person from Haryana could
    have possibly  developed such a deficiency .This
    has something to do with your diet during your
    sojourn in Europe. You should take an adequate
    amount of sun apart from nutrients.

    I was sorry to read at the time of the confusion
    over your visa that you had been victimized and
    denied your due .But that sometimes is a badge of
    honour .

    I am too well known to worry about sleuths.
    I did not want the host organization to pay
    for excess baggage for the legal documents
    circulated to Tribunal members and in a very
    tiny way  I am  a disciple of Gandhi who
    maintained that we must search for the truth,
    without being concerned who is watching over
    us !!!!!!!!!!!!!

    When a system is ready to destroy the
    genetic code of humanity for profits , what
    would you call it ........capitalism, corporatism,
    or OMNICIDE as Rosalie Bertel a Scientist
    who is also a nun has done .

    You have to be a mother and a woman
    to understand what it means killing and
    mutilating life giving capacity . A death
    sentence on the human race ,to which
    soldiers will also not be immune. I am
    awaiting the impact on employees of
    Security Agencies and Oil Companies 
    among others in the region.

    I learnt from citizens of India in Kuwait
    that after the first Gulf War when DU
    was used , the Kuwaitis stopped drinking
    their own water and drank only imported
    bottled water .

    Those whom the Gods wish to destroy they
     render mad first and we are witnessing the 
    madness .

      Mme La Juge,

       

      You would have made an excellent Supreme Court Justice in New Delhi .I am 
perhaps saying it because that is how I saw you first at KL Tribunal delivering 
your advisory opinion .But even if you were willing I presume none of the 
governments in Delhi would have dared raise you to the Bench . Nevertheless I 
would have rather preferred  to see you as the fiery and feisty prosecutor you 
were known as ,for your interrogation at among others the Srikrishna Commission 
, incidentally even intimidating the poor Justice himself .

       

      Not aware of the formal and judicially correct behaviour and norms of 
Tribunal members , I had wished to come over to Mumbai before going to KL. But 
I am happy that we can meet with when you come to Delhi next time .Soon enough 
! I was very happy when you did come over on the last day to our hotel after 
the formal dinner , from which the Tribunal was excluded to spend some time 
with us mere mortals .And even more delighted to meet you again at the KL 
airport .I was very touched but also uneasy that you walked me to the boarding 
gate , carrying that heavy load of your documents , which you naturally would 
not trust to leave out of your sight , with sleuths prying around for such 
material .

       

      The stay at KL though hectic and tiring after the last days running 
around in Delhi was very educative and even humbling , meeting the victims of 
Guantamano  and Abu Gharaib Gulags whom the white racist ghouls tried to divest 
of all dignity and integrity . We now await the downfall of the latest series 
of tyrants in the eternal historical process .How so ever they may wriggle and 
try , their fall is but certain .

       

      Thank you for everything and when are you coming over to Delhi ?
