The way this constant check occurs is much different in the new code on which I am working right now. The code you are looking at (the visitation) was a band-aid. The better way to do it is as part of the tree building which is what happens now.
The recursive descent here is known to be problematic in a few situations. For example, another is that it can lead to stack overflow exceptions even if the recursion is not infinite.
