IANAL, but… I would argue that these PDFs are “non-functional” in the sense that they do not have any impact on the functionality of Poppler. It may also be that this qualifies as fair use (AIUI, we’re talking about pages extracted from larger PDF files, right?). What does Debian do? :-) Ludo’.
