No. The new document opens:

"By committing to Mozilla repositories - that is, by directly
contributing source code, documentation or other data ("Code") to a
website or repository operated, controlled or managed by the Mozilla
Foundation or its affiliates (a "Mozilla Repository") - you are
indicating your agreement to the terms set out below."

They could argue that they'd never seen the document - but it is linked
from the access procedure and they are told to make sure they are OK
with it. I'll be filing follow-up bugs to get the link put in the README
files of our Github repos.

The document is, and always was, a promise of good behaviour, not a
legally binding contract. I doubt we would ever sue a Mozilla
contributor - that sort of thing doesn't tend to lead to greater
contribution from anyone!
