There are several examples of v2 infowindow behavior here:
http://www.geocodezip.com/v3_polygon_example_donut.html

Because google didn't implement it that way you have to be sure to
cover all the cases to get it to behave the way you want (Your
description above doesn't sound quite like v2 behavior, but it might
be)
