I run mdev here, but haven't run into the problem you're describing.
I don't have an /etc/fstab entry for /dev/pts, so I'm not entirely sure
where it's starting, but it's definitely here.
$ mount | grep pts
devpts on /dev/pts type devpts (rw,nosuid,noexec,relatime,gid=5,mode=620)
$ ls -l /dev/pts/
total 0
crw--w---- 1 misternono tty 136, 0 Jan 6 14:27 0
crw--w---- 1 misternono tty 136, 1 Jan 6 13:48 1

Unless it's started by mdev via "rc-update add mdev sysinit".
