I patched my standard gentoo kernel this way: http://onyon.net/index.php/2005-02-18_16.00.28_swsuspondelllatituded800 When you run apply and it complains about not being able to patch kernel cleanly move that patch out of the way and rerun apply, repeat this until all working patches are applied.
