Benson asked a policy question which might require thought on trademarks@.  My 
unofficial thought is: Apache projects must choose names that are not likely to 
be infringing on other existing marks, when taking into account that we always 
use a primary branding of Apache Foo, and the fact that we are a non-profit 
that provides software for the public good.

So from a policy perspective, I'm thinking the ASF will insist that it's 
projects not choose names that would infringe on other organization's names (or 
other Apache projects).  Defensibility is something that we need to ensure we 
inform the project about, but the final decision for choosing the name is up to 
the project.

If the Apache Rat podling is scurrying hard to keep the name, they should 
choose it.  If they want something that will ensure only they can eat their 
unique cheese, they should consider a more unique name.  But it's up to the 
podling to choose.
