In your CLA - you attest that you have that right. If you don't - it's on you to remedy it. The ASF doesn't broker relationships between developers and their employers, clients, or spouses :) So the CCLA exists for those who's employment agreements would otherwise cause them to violate their claims made via their CLA contract.
