All the compilers I use for testing were configured with --enable-checking - even GCC 2.95.3 ;). Which means your guess is wrong. The ICE doesn't happen on the 4.1 branch even with checking enabled. -- http://gcc.gnu.org/bugzilla/show_bug.cgi?id=27397
