The only reason you might conceivably get away with that is because a big league dev wouldn't want to risk bad publicity by taking a blind person to court. You're still breaking the law by using the sounds from another dev's game in your own. Phil took a gamble when he used Pac-Man sounds in Pac-Man Talks, but again, it's highly unlikely that a mainstream developer would want to risk their reputation by targetting one blind inddividual who's very unlikely to have the kind of money they'd want. I'd say the risk to reputation would be the only thing holding those devs back. It ain't pretty when the pretty leaves you with no place to go. J.D.
