Indeed, comment from tilespec.c:4546 (current TRUNK):

No indication has been given why it's like that (has the goal been that
darkness affects only foliage while light hits higher trees?)
Attached patch moves darkness to be applied on top of all three terrain
layers.
It could make sense to move it even higher than that, but that would require a
bit bigger changes to code (it's currently drawn as part of the terrain
layers). It could very well be drawn just below LAYER_FOG, and could have
layer of its own.
