Thanks an other issue is tap needs to be reset on reboot of the guest
is there anyway around this?

I have had good success setting the following my /etc/sysctl.conf on the
hosting machine:

net.link.tap.up_on_open=1

It allows me to to run a cycle of:
        bhyveload
        bhyve
        bhvyectl --destroy

To keep virtual machines happy.
