I believe you're right. It's important to distinguish between Darwin,
the kernel on which OS X is based, and the full OS X suite which
includes the Quartz graphics engine and Aqua user interface. It's only
the latter which is restricted to Apple hardware. As long as the
Hackintosh project isn't using any of the restricted software, there
shouldn't be any license violation.
But frankly, once you give up the things that give OS X its "pretty
face", you might as well install FreeBSD instead.
