Portmaster calls pkg_create to do this, so that's either going to succeed or fail. If it fails, then the user can do as you suggest and skip the backup package, or try to remedy it in other ways. But portmaster should not try to do the thinking for the user.
you should be able to use the flag that prevents the port backup (-B) and it should work for ya.
