I had a similar problem several years ago, and the problem was that the battery connector that connects the cell holder to the circuit board wasn't fully inserted into the pins on the circuit board. Open the KX3 up and make sure the connector is fully mated. That would make some sense. The KXBC3 Charger Installation and Operating instructions say the BAT ERR is due to, "Battery missing or battery voltage out of range due to a fully charged pack or a defective or missing cell." An intermittent connection would probably fit that description.
