'fresh_install' broken on a completely clean system

After checking out trunk to a completely clean system, and running mvn package
/ install... going into the dspace/target area and running 'ant frest_install'
fails:

Running 'ant update' first copies the code / configuration to the installation
area, and 'fresh_install' then works correctly.
