You are right, the AtomPub binding behavior +may be+ different in the 
{{create}} case compared to the other bindings. This is not "intended" by the 
OpenCMIS implementation, but rather a consequence of the different ways how 
{{create}} is defined in the CMIS specification.

In the Browser Binding and Web Services Binding, the OpenCMIS server framework 
can catch such inconsistencies. In the AtomPub Binding case, the server 
developer has to provide these checks (for example, see 
[here|https://svn.apache.org/viewvc/chemistry/opencmis/trunk/chemistry-opencmis-server/chemistry-opencmis-server-fileshare/src/main/java/org/apache/chemistry/opencmis/fileshare/FileShareRepository.java?revision=1696946&view=markup#l420]
 and 
[here|https://svn.apache.org/viewvc/chemistry/opencmis/trunk/chemistry-opencmis-server/chemistry-opencmis-server-fileshare/src/main/java/org/apache/chemistry/opencmis/fileshare/FileShareRepository.java?revision=1696946&view=markup#l663]).
 If such checks are missing, you will get the behavior that you have described.
