toURL does not properly escape illegal characters (see javadoc) so you end up kind of like my horrible current hack.
I just checked jaxp implementation, the current implementation in the main branch (jaxp 1.3) for parse(File) is still wrong as well AFAIK, it is different between from the one in the tck-jaxp-1_2_0 branch which does escape. mmm...
