Ok, GNOME3 was not the cause, still had the problem after removing. Went back and determined things changed since installing 12.10 distribution. Found that the real cause is the theme you are using. If you set Adwaita or High Contrast or High Contrast Inverse the Data Table banner looses it's close and max/min options. The Ambiance and Radiance work fine.
