I personally agree with your perspective that this should not happen, but it is the designed behaviour (ask didrocks, willcooke). The intention was that the clock should be positioned to have the same centre line as any maximized window's title. P.S. The desktop icons seem to be moving in the wrong direction in your screenshots.
