Hmm. This problem has recently appeared for me on my Toshiba Satellite A200 running amd64 Maverick with the 2.6.35-14 kernel. I don't get an icon at all, and no battery tab in gnome power manager. Been running Ubuntu since 8.10 on this laptop and this problem has only cropped up recently.
I also don't get notifications when I adjust screen brightness anymore, I think that's related.
