I did some more testing and loaded all of the newest updates available. I believe the swap file is corrupt. After a mkswap the laptop does shutdown during a hibernate but boots up like I never did the hibernate. After that the next hibernate will fail to shutdown or sometimes lock the laptop. I'll then have to force a reset with the power button.
