The bug is NOT labeled "delete" but "remove", which implies removing from the list and not deleting from the disk as you suggest. The empty trash action is clear, in the current situation it could be confusing for users, if they added some photos to the backgrounds choices and want to remove those from the list they should not have to worry about whether they will be deleted or just not listed in the capplet
