you can request the takeover of an abandoned project at sourceforge: http://sourceforge.net/apps/trac/sourceforge/wiki/Abandoned%20Project%20Takeovers They'll transfer the ownership if the current owner does not answer during nine weeks (AFAIK). This wouldn't solve the copyright issues, however you could push back your patches to a canonical location.
