Article 53 (1c) EU Artificial Intelligence Act and the Landgericht Hamburg do not agree with this statement. The exceptions for text and data mining can be used for training of generative AI. Copyright holders can opt-out in "an appropriate manner" (whatever that is), but not if the text and data mining is used for non-commercial scientific research.

The usage of copyrighted material for AI training is perfectly legal in Europe but the redistribution of said material by Debian would be illegal.
