I think it's different enough (even though a pretty obvious gimp-up of part of the Debian logo) that it would be kinda like Cingular getting sued by Handspring for using a little icon of a human doing a jumping jack (since Handpsring and pretty much every other tech company from around the same era all used remarkably similar generic anthropomorphic corporate logo. - -- .''`.
