A good tool for finding out if a particular IP address is in use is arping. Try the "-D" option for duplicate detection. You can do this with the interface up, but with no address assigned. IIRC, some DHCP clients will do this automatically before accepting an address, and should request another one. You can often configure your DHCP client to request a specific address, and that might help. Take a good look at the manual for your DHCP client to see what other options it has that might help, and to help debug the problem. You could also try a different DHCP client; maybe something your DHCP client is doing is confusing the Windows server. There are several DHCP clients available for Linux which are in wide use; the ISC DHCP server is probably the oldest and so may be the most likely to be compatibility-tested.
