The idea initally was not to explicitly be a fork (go on a different development path). lllumos was to follow OpenSolaris closely, except replacing closed binaries and maintaining drivers upstream may drop. I guess you can technically call this a fork.. but the idea was to be close. Now, Illumos has no real upstream, and is maintaining the last code drop, and will merge changes from future code drops.
