This clause is incompatible with the DFSG. It was one of several objections to OSL 2.0[1]. Objections[2] to sections 3, 6, 9, 11 and 12 also apply to this license and appear to match recent DFSG interpretations (although the DFSG compatibility of choice of venue and fee-shifting clauses are occasionally argued over).
