Well, Linus claims the kernel has an exemption, though I've never heard an explanation of how Linus has any authority to do so ... (For example, Linux contains the driver portion of ALSA, and I see no exceptions in alsa-driver/COPYING, so there's no reason to believe people submitting driver code to ALSA intend to grant any such exception, if such a thing really is required.
