I had to install a 2.6.23 linux kernel to add unrelated functionality to my setup and after a bit a fsk'ing around the device is now working. So I guess the "solution" for anyone using an HP M820 CD-Writer with the original "KME" PC card provided by HP is to upgrade to 2.6.23+ presumably pulling in the state-of-art Ninja driver ..
