There is no reason why a kernel bug should only be fixed in userspace. If you look at the kernel.org bugtracker (where this bug was forwarded to!) you'll see that it is still happening with recent kernels - and it is easy to trigger, even without using dpkg. Still happens with .38. And it became even worse with .38 - one crash per day instead of one every other week.
