Isn't the copyright owned by Sun
(https://jai-core.dev.java.net/source/browse/jai-core/COPYRIGHT.txt?rev=1.2&view=markup).
If so you might get some help from Sun's Open Source "Ombudsman" -
http://www.sun.com/software/opensource/ombudsman.jsp.

I found Sun very helpful sorting out a similar licensing problem with
JavaCC. I don't know if the Oracle deal will have changed anything.
