as I wrote in my very first e-mail about JRockit, it's non-free, and will remain so for the foreseeable future. Thus, the only way it would enter Debian would be through the non-free part of the Debian distro.
So you're correct in that it doesn't fulfill the DFSG. But that shouldn't stop it from entering non-free.
