Not necessarily. Firmware-as-software and firmware-as-hardware are covered by different laws. You can disclain warranty on software but not on hardware. You can resale hardware but not software license, etc. This has real implication. Companies have legal incentives to move from hardware to software license, which are not to the benefit of the users.
