Thanks for reporting! This issue had been fixed in 0.7.8 release of
fail2ban. Also I consider it not of grave importance -- it is not a
security hole since 

1. apache is not default filter used out of box
2. on its own it doesn't create possibility to gain access to the
   system. It just doesn't perform required/desired action -- ie
   banning, so that just lifts up the curtain

I will  see if any other fixes should be incorporated and then
will buzz either security or proposed-updates team, which upload would
finally close the bug.

Meanwhile you can give a try to the patched etch version:
