It wasn't required to trigger the problem on my system either, but it seemed to happen a lot more often in the first few minutes after coming out of hibernation.

On my system I could go for weeks without incident, and then have it happen three times in a couple hours. It also appeared to be more prevalent with some versions of the kernel than others (though this may be an illusion due to the irratic nature of the problem). How long did you run it on 2.6.39 previously? Perhaps it would have happened with 2.6.39 previously had you used it for a longer period?
