I also get this problem with 1.6.1 (while 1.5 works ok). Not always, but here's a reproducible test case. (I trimmed the message contents for privacy reasons, hope I didn't break the MIME structure in the process, but the bogus error is the same.) According to strace, mpack tries to create (with O_EXCL) tempdesc.txt twice, so the second one fails.
