Actually, it should not complain given the following code:

permitrootlogin=`cat ${I}/sshd_config | grep "PermitRootLogin" | grep -v "#"`

As you can see, the commented lines are not considered (grep -v "#")

Can you please send the relevant parts of the rkhunter log file?

Also, what is your ALLOW_SSH_ROOT_USER option in /etc/rkhunter.conf (I
guess "no", given the message you get)?

For your information, newer releases do not have this issue.
