Are you positive that you are experiencing 313079, which is:

$ mkdir -p x/y
$ find x/y -depth -type d -empty; echo $?
find: x/y: No such file or directory
1

I am asking because I could easily reproduce this previously and
cannot anymore. I strongly suspect you are talking about
