Hi,
support for disabling the automatic updating of the MOTD was removed
sometime in summer 2007 IIRC.
The bug was 'fixed' by removing the test in SVN:

but apparently not uploaded afterwards. The tests should be updated for
typical configuration issues with Lenny anyway.
I.e. settings that are incompatible with SELinux, especially with the
reference policy, such as postfix chroot.
Maybe this bug should be reassigned to refpolicy and/or initscripts,
because all this test did was basically to suggest a way of resolving a
common SELinux error message (SELinux with the policy we had back then
would not allow init to update the motd file).
Now that the initscripts option has been removed, I see three
possibilities:
- re-add the option or a similar choice (e.g. only updating
when /etc/motd is a symlink to /var/run/motd)
- split out the motd updating code into a separate script to allow
adding a SELinux role transition, allowing for a clean but bigger policy
change
- modify policy in an ugly way to allow updating the motd file, if this
is actually possible without becoming too messy.
