I have this behavior with several other daemons from /etc/init.d/ too.
I can stop them by hand in a terminal but calling if from another
program does not work, even if running as root.
My Intranet Server is running Etch with Apache + php5, Courier, vsftpd,
sshd, smstools, nfs-kernel-server.
