Because the file was added to initscripts without flagging it as a conffile in version 2.86.ds1-16, and flagged as a conffile in version 2.86.ds1-18. So for those upgrading to version 2.86.ds1-18 or later from stable or testing (or any version before 2.86.ds1-16) with an existing /etc/init.d/rc.local should and will get a conffile question, and those upgrading without such file should and will not get a conffile question. So it will only affect the unstable users who installed the broken 2.86.ds1-16 and 2.86.ds1-17 versions.
