This phrase is part of the copyright statement. I do not understand why you think it is not binding. They went further than that, which would lead a reasonable person to believe that they intended a greater effect. They even put it in french, which strongly implies that they meant it to apply to Canadians. If Sun does not intend that to be the case, then they can remove the phrase. It is easy for Sun to fix.
